Welcome to Hermes ("Hermes," "we," "us," or "our") provided by Relative Industries LLC. These Terms of Service ("Terms") govern your access to and use of our website at hermesvoice.com (the "Website"), our voice-to-text application for Mac (the "App"), and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To access certain features of the Services, such as the Pro subscription or lifetime deal, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Use of the Services
3.1 License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your Mac device for personal or professional use. This license does not permit you to modify, reverse-engineer, decompile, or create derivative works of the App.
3.2 Features
The Services include voice-to-text dictation, personal dictionary building, support for over 100 languages, offline private mode, and customizable voice commands (Triggers). Use of these features must comply with applicable laws and these Terms.
3.3 Prohibitions
You agree not to:
- Use the Services for any illegal or unauthorized purpose.
- Interfere with or disrupt the Services or servers.
- Upload or transmit viruses, malware, or harmful code.
- Attempt to gain unauthorized access to any part of the Services.
- Use the Services to infringe on third-party intellectual property rights.
- Resell, rent, or sublicense the Services without our written permission.
4. Privacy and Data
Your use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference. In offline mode, all data processing occurs on your device and is not transmitted to us. In online modes, we may collect usage data to improve the Services. You consent to such collection and use as described in the Privacy Policy.
5. Payments and Subscriptions
5.1 Free Trial
We offer a free Pro trial without requiring a credit card. The trial provides access to premium features for a limited period.
5.2 Subscriptions
- Monthly: $12 per month.
- Annual: $120 per year (equivalent to $10 per month).
Subscriptions auto-renew unless canceled at least 24 hours before the renewal date. You can cancel via your account settings.
5.3 Lifetime Deal
A one-time payment of $150 (or $199 after the initial promotion) grants perpetual access to premium features without recurring fees. This is non-refundable and limited in availability.
5.4 Refunds
All payments are non-refundable except as required by law. We may issue refunds at our discretion.
5.5 Taxes
You are responsible for any applicable taxes on payments.
6. Intellectual Property
All content, trademarks, software, and other materials in the Services are owned by us or our licensors and protected by intellectual property laws. You may not copy, distribute, or exploit them without permission.
7. User Content
Any text, commands, or data you input into the Services ("User Content") remains yours. By providing User Content, you grant us a non-exclusive, royalty-free license to use it solely to provide and improve the Services.
8. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or other reasons. Upon termination, your license to use the App ends, but offline features may remain functional on your device.
9. Disclaimers
The Services are provided "as is" without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. We do not guarantee error-free operation or uninterrupted access.
10. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility. Our total liability shall not exceed the amount you paid us in the past 6 months.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Services or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any disputes shall be resolved in the courts of San Francisco, California.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will notify you of material changes via email or the Website.
